This policy explains what personal information Baja AI LLC (“Baja AI,” “we,” “us”) collects through our websites and applications, including baja-amigo.com (the “Services”), how we use it, and the choices you have.
1. Information we collect
- Account information — name, email address, password credentials and any profile details you choose to add.
- Purchase information — plan, amount, billing country, and the last four digits and brand of your card as reported to us by our payment processor. We never receive or store your full card number, CVC or bank credentials.
- Content you submit — posts, reviews, listings, support messages, and the questions you send to our AI assistant.
- Usage and device data — pages viewed, approximate location derived from IP address, browser and device type, referring page, and timestamps, collected through server logs and cookies.
2. Cookies
We use cookies and similar technologies that are strictly necessary to run the Services — keeping you signed in, remembering preferences and protecting against fraud — and, where enabled, cookies that help us measure aggregate usage. You can block or delete cookies in your browser settings, but parts of the Services may stop working if you block necessary cookies.
3. How we use information
- To provide, maintain and improve the Services and answer your questions.
- To process payments, manage subscriptions and send billing notices and receipts.
- To send service messages, and — only with your consent where required — occasional product news. You can unsubscribe from marketing email at any time.
- To detect, prevent and investigate fraud, abuse and security incidents.
- To comply with legal obligations and to establish or defend legal claims.
Where the GDPR or UK GDPR applies, we rely on performance of a contract (to give you the Services you signed up for), our legitimate interests (to secure and improve the Services), your consent (for marketing and non-essential cookies), and legal obligation (for tax and accounting records).
4. Who we share information with
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share it only with service providers who process it on our behalf under contract, including:
- Stripe, Inc. — payment processing, subscription billing and fraud prevention.
- Hosting and infrastructure providers — to run and store the Services.
- Email delivery providers — to send transactional and support email.
- AI model providers — when you use our AI assistant, your question and the relevant context are sent to a third-party model provider to generate a response. Do not enter sensitive personal information into the assistant.
We may also disclose information if required by law, subpoena or other legal process, to protect our rights or the safety of others, or in connection with a merger, acquisition or sale of assets (in which case we will notify you).
5. International transfers
We are based in the United States, and our providers may process information in the United States and other countries. Where required, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses for transfers out of the EEA and the UK.
6. Retention
We keep account information for as long as your account is active and for a reasonable period afterwards. Transaction and tax records are kept for at least seven years as required by U.S. law. Server logs are typically retained for up to 12 months. When information is no longer needed, we delete or anonymize it.
7. Security
We use encryption in transit (HTTPS), access controls, and reputable infrastructure and payment providers to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
8. Your rights
Depending on where you live, you may have the right to access, correct, delete or receive a copy of your personal information; to object to or restrict certain processing; to withdraw consent; and, under California law, to know what we collect and to not be discriminated against for exercising your rights. Email support@baja-ai.com and we will respond within the time required by applicable law, generally within 30 days. We may need to verify your identity before acting on a request. If you are in the EEA or UK you may also complain to your local supervisory authority.
9. Children
The Services are not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has given us personal information, email us and we will delete it.
10. Changes
We may update this policy. We will post the new version with an updated date and, for material changes, notify account holders by email.
