Terms of Service

These Terms of Service (the “Terms”) govern your use of the websites, applications and services operated by Baja AI LLC, a Wyoming limited liability company (“Baja AI,” “we,” “us”), including baja-amigo.com (collectively, the “Services”). By using the Services you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be at least 18 years old to create an account or make a purchase. You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for all activity under your account. Tell us promptly at support@baja-ai.com if you believe your account has been used without your permission.

2. Paid plans, billing and renewal

• Some features are offered as paid membership plans. The price, billing period and included features are shown before you complete a purchase.
• All prices are in U.S. dollars (USD) and exclude any taxes that may apply.
• Payments are processed by Stripe, Inc. By purchasing, you also agree to Stripe's applicable terms. We do not receive or store your full payment card number.
• Paid plans renew automatically at the end of each billing period at the then-current price until you cancel. You authorize us to charge your payment method on each renewal.
• You may cancel at any time from your account settings or by emailing us. Cancellation and refunds are described in our Refund & Cancellation Policy, which forms part of these Terms.
• We may change prices with at least 30 days' notice by email; changes apply to billing periods beginning after the notice period.
• If a payment fails, we may retry it and may suspend paid features until payment succeeds.

3. Acceptable use

You agree not to: break the law or infringe anyone's rights while using the Services; scrape, resell or redistribute our content or data without permission; attempt to gain unauthorized access to our systems; interfere with or overload the Services; upload malware; misrepresent who you are; or use the Services to generate or distribute unlawful, harassing, fraudulent or deceptive content. We may suspend or terminate accounts that violate these Terms.

4. Information, AI output and no professional advice

The Services provide general information — including border wait times, exchange rates, translations, directory listings, guides, and responses produced by AI assistants. This information is provided for convenience only. It may be incomplete, outdated or wrong, and AI-generated responses can be inaccurate.

Nothing in the Services is legal, immigration, tax, financial, medical or safety advice. Do not rely on the Services for decisions about border crossing, immigration status, permits, real estate, health or personal safety. Verify anything important with the relevant official authority or a qualified professional.

5. Third-party content and links

The Services include content, listings, advertisements and links supplied by third parties. We do not control and are not responsible for third-party content, websites, businesses or transactions. Dealings with third parties are solely between you and them.

6. Your content

You keep ownership of the content you submit (for example, forum posts, reviews or listings). You grant Baja AI a non-exclusive, worldwide, royalty-free license to host, store, reproduce and display that content for the purpose of operating and promoting the Services. You confirm you have the rights to the content you submit. We may remove content that violates these Terms.

7. Our intellectual property

The Services, including their software, design, text, graphics and compilations of data, are owned by Baja AI LLC or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Services for your personal or internal business use, subject to these Terms.

8. Disclaimer of warranties

The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Services will be uninterrupted, secure or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Baja AI LLC and its member, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to your use of the Services. Our total liability for all claims relating to the Services will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Baja AI LLC from claims, damages, liabilities and reasonable legal fees arising out of your use of the Services, your content, or your violation of these Terms or of applicable law.

11. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Services. Sections that by their nature should survive termination — including sections 6 through 13 — will survive.

12. Changes to these Terms

We may update these Terms. If a change is material, we will give notice by posting the updated Terms with a new “last updated” date and, for account holders, by email. Continued use after the change takes effect means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. You and Baja AI agree that any dispute will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and each party consents to the jurisdiction of those courts. Nothing here prevents either party from seeking relief in small claims court.
